30-Day Comment Period for National Energy Board Proposed Regulations for Pipeline Damage Prevention in Canada Gazette Part I

The Pipeline Safety Act (Bill C-46) received royal assent on18 June 2015, and makes amendments to the National Energy Board Act (NEB Act) that will be in force within one year.  Due to the Pipeline Safety Act amendments to the NEB Act (sections 2 and 112), the NEB must update its regulations for pipeline damage prevention.

In addition, the proposed regulations include amendments to aspects of the damage prevention framework that were previously developed. These amendments relate to formalizing the requirement for a pipeline company to have a damage prevention program and one-call centre requirements for both companies and anyone planning an activity near a pipeline.

The proposed regulations are:

  • National Energy Board Pipeline Damage Prevention Regulations - Authorizations
    • Will replace the National Energy Board Pipeline Crossing Regulations, Part I
  • National Energy Board Pipeline Damage Prevention Regulations - Obligations of Pipeline Companies
    • Will replace the National Energy Board Pipeline Crossing Regulations, Part II
  • Regulations Amending the National Energy Board Onshore Pipeline Regulations
  • Regulations Amending the Administrative Monetary Penalties Regulations (National Energy Board)

The proposed regulations are issued in the Canada Gazette, Part I on 19 March 2016, for a 30-day comment period, with written comments to be submitted by 18 April 2016. The proposed regulations and the Regulatory Impact Analysis Statement are available on the Canada Gazette website:
