30 Day Comment Period on Proposed Amendments to Regulations for Pipeline Damage Prevention

The National Energy Board (NEB or the Board) is proposing to amend its regulations relating to pipeline damage prevention as set out in the attached proposed regulatory amendments. The proposed regulatory amendments will apply to NEB regulated pipeline companies and to any person planning or undertaking an activity with the potential to damage pipelines regulated by the Board. At this time, the Board invites all regulated companies and interested parties to provide written comments on the proposed regulatory amendments.

The regulations that would be amended as a result of this initiative are the:

  1. National Energy Board Pipeline Crossing Regulations, Part I (PCR Part I)
  2. National Energy Board Pipeline Crossing Regulations, Part II (PCR Part II)
  3. National Energy Board Onshore Pipeline Regulations (OPR), and the
  4. National Energy Board Administrative Monetary Penalties Regulations (AMPs).

These proposed amendments advance the regulation development commitments made in the July 2011 Action Plan on Safety and Environmental Protection, the February 2012 Damage Prevention Framework, the December 2012 Discussion Paper - Proposed Changes to NEB Regulations for Damage Prevention, and the November 2013 Notice of Proposed Regulatory Change (NOPRC). Feedback received as a result of these regulatory initiatives was considered in the development of the proposed regulatory amendments.

On 26 June, 2013, the Honourable Joe Oliver, Canada's former Minister of Natural Resources, announced the Government of Canada's latest steps to enhance Canada's pipeline system (Media Release and Backgrounders). As a result of this announcement, several legislative amendments may be anticipated and consequential regulation amendments may follow. As the proposed amendments have not yet been introduced in Parliament, changes to regulations that may be required were not included in the NOPRC or in the attached proposed regulatory amendments.

Providing Written Comments

The closing date for submitting written comments is Monday, 20 October 2014. Comments may be provided electronically, in hard copy by mail, or by fax and sent to the contact information below.
