Regulatory Stock Review Plan

Overview

This Regulatory Stock Review Plan describes the planned reviews of regulations that the Canada Energy Regulator (CER) is proposing within the next 3 year period. It is intended to give Canadians, including businesses and Indigenous peoples, and trading partners, greater opportunity to inform the reviews of regulations and to plan for the future.

The Regulatory Stock Review Plan identifies a CER contact point for the planned reviews. The Regulatory Stock Review Plan will be adjusted and updated over time to reflect the CER’s regulatory priorities and changes to the operating environment.

Regulatory Stock Review Plan: 2025–2028

Cost Recovery Regulations

Enabling act(s): Canadian Energy Regulator Act (CER Act)

Rationale: The regulations will be updated to reflect the changes in the regulation-making authority introduced by the CER Act

Narrative: Section 87 of the CER Act provides that regulations may be made for recovering all costs attributable to the CER’s mandate, including costs for applications that are denied or withdrawn. The existing Cost Recovery Regulations will be amended to reflect this regulation-making authority.

Export and Import Regulatory Framework

Enabling act(s): Canadian Energy Regulator Act (CER Act)

Rationale: The regulations are being updated to align with the CER Act and to reflect previous stakeholder feedback.

Narrative: On 6 July 2012, the Government of Canada enacted the Jobs, Growth and Long-Term Prosperity Act which made amendments to the NEB Act that affects the NEB’s export and import regulatory framework.

On 28 August 2019, the CER Act came into force. The CER Act contains similar regulation making authorities as the repealed NEB Act with respect to the federal export and import regulatory framework.

Stakeholder Feedback: Engagement on proposed changes was conducted from August to October 2013. Stakeholders asked that the NEB continue to make export and import data available for their use, and to continue to develop the draft regulations with a view towards maintaining stability across the systems. These comments were revisited as part of the 2019 review.

Proposed regulations were pre-published in the Canada Gazette, Part I from 14 December 2024 to 28 January 2025. The CER received feedback from 7 commenters. All comments will be reviewed by the CER and considered as part of the regulatory development process.

Onshore Pipeline Regulations

Rationale: This is a planned review and update of the Canadian Energy Regulator Onshore Pipeline Regulations, for continual improvement, under the Canadian Energy Regulator Act.

Rules of Practice and Procedure

Enabling act(s): Canadian Energy Regulator Act (CER Act)

Rationale: A comprehensive update to the National Energy Board Rules of Practice and Procedure, 1995 (Rules) is needed to align with the CER Act, reflect the CER’s new governance structure, and to formalize the practices, processes and terminology which have evolved in the years since the Rules were first in effect.

Narrative: The planned steps for this regulatory review include:

  • Phase 1: Early Engagement (Fall 2024)
  • Phase II: Summary Report for Publication and Comment (Spring 2025)
  • Phase III: Consultation on Draft Regulations in Canada Gazette I (Fall 2025)
  • Phase IV: Final regulations published in Canada Gazette II (Winter 2026)
